The Building Safety Act 2022
is a UK law designed to improve building safety. It introduces stricter rules for compliance with the building regulations for mainly high-risk buildings (HRB) (18m+/7+ Storeys) and non-high-risk buildings and enhances accountability within the construction and management sectors.

THE BEGINNING

Changes to the Building Act 1984

The BSA amends the Building Act 1984 to strengthen the Building Regulations framework and applies to all buildings, not just high-risk and compliance must be demonstrated and approved prior to any work commencing on site.

LIABILITY

Stronger Enforcement & Sanctions

The BSR and local authorities have gained enhanced powers to stop unsafe work with the capabilities to impose maximum fines and criminal penalties for serious safety breaches.

The duty holders are now exposed to extended liability periods:

  • 15 years for dwellings due to be completed after 28th June 2022

  • 30 years for dwellings due to be completed before 28th June 2022

Duty Holders & Competency Requirements

The Principal Designer & Principal Contractor are responsible for compliance with the Building Regulations, furthermore, the Accountability Framework ensures clear responsibility throughout a building’s lifecycle.
